Case Law Favors Prosecutor in Misconduct

California State Bar Judge Patricia McElroy decided not to strip the license to practice law from a prosecutor accused of professional misconduct. The Santa Clara County prosecutor claims he didn’t withhold evidence on purpose. Prosecutor Benson was accused of concealing a videotape of a medical examination of the “victim” from the defense attorney until after the trial and then lying about it under oath.
